Collecting Loose Figures is now Illegal

A new federal law is raising concerns and questions across the United States. On February 10, 2009 it will be illegal to re-sell any used children's products including toys and clothing. That is according to the U.S. Consumer Protection & Safety Commission who pushed for the new laws after dozens of toys were recalled in 2008 because of lead concerns.

 

Toys, clothing and other items used by children under 12 will be subjected to lead testing and will have to have labels on them to prove that they have passed inspection. What is raising the ire of parents and business owners far and wide is what this will mean to clothing, toys and other children products made before February 10, 2009. Gary Walthall, the owner of Once upon a Child, a resale shop specializing in children's clothing and other items, is afraid that he'll have to close up shop.

 

Adding to the confusion and frustration is the fact that the U.S. Consumer Products and Safety Commission is not returning calls or e-mails to the countless re-salers and even journalists who have tried in vain to get clarification on what the law means to garage sales and how it will be enforced.

 

 

This means buying and selling loose figures off ebay is now illegal. This is very real and there are no know loop holes as of now. This means ebay will comply and ban you from selling them. We now will have to get our vintage figures in back alley next to the crack dealers.

You should have made a little different Title... it won't be illegal to "Collect" them it'll be illegal to sell them ...... if some-one gave them to you for free , then it's all fine ... but if you sell it , that's a different story.

 

 

And you know what ...

 

 

I think that this whole thing is a freaking fluke.... a joke ... I mean why in the world isn't this on any major news networks ? and why the heck would they make a law like this and only tell people a month before it goes into effect?

It sounds like the only way this affects anyone (other than toy companies) is if the law is retroactive. Ie, if anything made before 2/10/2009 has to go back and be tested by a third party, then ebay, garage sellers, etc would be affected.

 

If it's on a go forward basis, then everything new has to be tested; once those things become used, they can be sold second hand as it would be assumed they were tested.

Hey this sounds like it only deals with children toys. Because thiers have lead and ares are plastic. This doesnt seem really real. I havent heard or readanything on this.

 

 

Every action figure you own is considered a toy. This affects all of us.

 

I know that, but usually only children toys need to be tested for lead and such.

It is a law that to first impression does not sound very clear in its terms and limitations, and to ears of others sounds absurd and controversial, but the recommendable thing is to read it exactly and to understand in that level affected those consuming loyal collectors of the simple accidental buyers that they see something interesting in a sale of Garage or the closing of a store.

 

I hope that it does not mean with all clarity that is the aim of the purchases of figures in the conventions, Ebay and the stores of comics or simply between friendly. On the other hand and seeing the positive side this new law, it establishes illegal to sell resemblances articles in the United States, but not extended the prohibition to Canada, Mexico or any other country, thus… that are all's Welcome! here always we have many loose figures that to sell!

 

according to this focused in protecting to the minors against articles seems the law whose manufacture highly includes nocivius elements produced by companys that in search of saving costs filths with the articles do that put on sale, this law seems enfocada in forcing the great marks of toys to reevaluar the quality of its products to standard majors of quality and coverall to that they determine with greater seriousness the age allowed for the acquisition of toys to the 12 minors of years . Instead of so absurd laws they deberian to make laws more severes that prohibited the sale and distribution of pornography, videogames too many violent ones and the alcohol to minors.

What certifications are required for children’s products that are tested for lead paint?

 

For currently effective lead paint limits (600 ppm), general conformity certification is required for products manufactured after November 12, 2008 based on a test of the product or a reasonable testing program for products. Third-party testing of the product for currently effective lead paint limits by accredited third party laboratories is required for products manufactured after December 21, 2008.

 

When the lead paint limit is lowered to 90 ppm on August 14, 2009, third-party testing by accredited third party laboratories will be required for children’s products manufactured after that date.

 

Calm down. It's a go forward basis. Geez.

Sec 12 Mandatory Third Party Testing for Certain Children's Products

 

"(1) General Conformity Certification.---Except as provided in paragraphs (2) and (3), every manufacturer of a production safety rule under this Actu or similar rule, ban, standard, or regulation under any other Act enforced by the commission and which is imported for consuption or warehousing or distributed in commerce (and the private labeler of such product if such product bears a private label) shall issue a certificate which ----

 

That reads to me that the testing is on the manufacturer and not the seller.

 

Seriously, if this law was as bad as you originally made it out to be it would shut down garage sales.
